Terms of Service

1. Acceptance of Terms
By accessing or using MyReviewPulse (“the Service”), operated by KDigital LLC (“we”, “us”, “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
2. Description of Service
MyReviewPulse is a review request automation platform that enables businesses to send SMS and email messages to their customers requesting feedback and reviews. The Service includes a web dashboard, API endpoints, analytics, and related tools.
3. Account Registration
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, current, and complete information during registration. You must be at least 18 years old to create an account.
4. Acceptable Use Policy
You agree to use the Service only for lawful purposes and in compliance with all applicable laws. Specifically, you agree that you will:

Obtain express consent from individuals before sending messages. You are solely responsible for compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and all applicable federal, state, and local laws regarding electronic communications.
You must NOT:
- Send unsolicited messages (spam) to individuals who have not consented
- Send messages containing threats, harassment, or abusive content
- Generate, solicit, or facilitate fake reviews or fraudulent testimonials
- Offer incentives (discounts, gift cards, etc.) in exchange for reviews — this violates FTC guidelines and Google's review policies
- Use review gating (filtering customers by sentiment before directing them to review platforms)
- Impersonate another business or individual
- Use the Service for any illegal purpose
- Attempt to reverse engineer, decompile, or disassemble the Service
- Exceed your plan's usage limits through automated means
- Resell or sublicense access to the Service without our written consent
We reserve the right to suspend or terminate your account for violation of this Acceptable Use Policy.
5. Your Responsibilities as a Data Controller
When you use the Service to send messages to your customers, you act as the data controller and we act as the data processor. You are responsible for:
- Obtaining all necessary consents from your customers before providing their personal information to us
- Ensuring the accuracy of customer data you provide
- Responding to data subject requests from your customers
- Complying with all applicable privacy laws in your jurisdiction
6. Payments and Subscriptions
Some features of the Service require a paid subscription. By subscribing to a paid plan, you agree to pay the fees associated with your selected plan. Fees are billed monthly in advance via Stripe. All fees are non-refundable except as required by law or as described below.
Refund Policy
You may cancel your subscription at any time. Upon cancellation, your paid plan will remain active until the end of your current billing period, after which your account will be downgraded to the Free plan. We do not offer prorated refunds for partial months. If you believe you were charged in error, contact us at billing@myreviewpulse.com within 30 days.
Price Changes:We may change our prices with 30 days' advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
7. Intellectual Property
The Service, including its design, code, features, and branding, is owned by KDigital LLC and is protected by copyright, trademark, and other intellectual property laws. You retain ownership of all content you provide to the Service (business information, customer data, custom templates). By using the Service, you grant us a limited license to use your content solely to provide and improve the Service.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KDIGITAL LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
9. Indemnification
You agree to indemnify, defend, and hold harmless KDigital LLC from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the Service; your violation of these Terms; your violation of any applicable law, including TCPA and CAN-SPAM; messages you send through the Service; or any dispute between you and your customers.
10. Account Termination
You may close your account at any time by contacting us at support@myreviewpulse.com. We may suspend or terminate your account at any time, with or without notice, for violation of these Terms, non-payment, or any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination, after which it will be permanently deleted.
11. Dispute Resolution
Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in class action lawsuits. Either party may seek injunctive relief in any court of competent jurisdiction.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
